Terms of service

Last updated: 22 August 2026

1. About us

This website and online store are operated by Whyte and Smith Socks Ltd, trading as Whyte & Smith.

Whyte and Smith Socks Ltd is registered in England and Wales under company number 16539738. Our registered office is:

11 Main Street
Rempstone
Loughborough
Leicestershire
LE12 6RH
United Kingdom

You can contact us at hello@whyteandsmith.com.

In these Terms, “we”, “us” and “our” refer to Whyte and Smith Socks Ltd. “You” and “your” refer to a visitor to our website or a customer purchasing our products.

2. These Terms

These Terms apply when you use our website or purchase products from us. They should be read together with our:

  • Privacy Policy;

  • Return and Refund Policy; and

  • Shipping Policy.

Please read these documents before placing an order.

Nothing in these Terms limits or excludes any rights or remedies that cannot legally be limited or excluded, including your statutory consumer rights.

3. Using our website

You may use our website only for lawful purposes.

You must not:

  • misuse, disrupt or attempt to gain unauthorised access to the website or its systems;

  • introduce viruses, malicious code or other harmful material;

  • use the website fraudulently;

  • infringe our rights or the rights of another person;

  • collect information about other users without authority;

  • use automated systems to access the website in a way that places an unreasonable burden on it or circumvents technical protections; or

  • use our content commercially without permission.

We may suspend or restrict access where reasonably necessary to protect the website, our customers or our business.

4. Accounts and customer information

You must provide information that is accurate, current and complete when placing an order or using a customer account.

You are responsible for keeping access to your account and email secure. Please contact us promptly if you believe that your account has been accessed without permission.

You must be at least 18 years old to place an order, or have permission from a parent or legal guardian who agrees to be responsible for the order.

5. Products

We take reasonable care to ensure that product descriptions, measurements, photographs and prices are accurate.

Colours and appearance may vary slightly between screens, devices and lighting conditions. Natural or manufacturing variations that do not affect the product’s conformity may also occur. Nothing in this section affects your rights where goods are faulty, materially different from their description or otherwise fail to conform to the contract.

Product availability may change without notice. Placing an item in a basket does not reserve it.

We may discontinue products or reasonably limit the quantity available to an individual customer.

6. Placing an order

When you submit an order, you are offering to purchase the products shown in your basket.

An automated order acknowledgement confirms that we have received your order; it does not necessarily mean that we have accepted it. A contract is formed when we send confirmation that the order has been dispatched, unless we expressly confirm acceptance earlier.

We may decline or cancel an order before acceptance where, for example:

  • a product is unavailable;

  • payment cannot be authorised;

  • pricing or product information contains an obvious error;

  • we cannot deliver to the supplied address;

  • we reasonably suspect fraud or misuse; or

  • the order breaches a purchasing restriction disclosed on the website.

If we decline an order after taking payment, we will refund the relevant amount.

Orders are intended for personal or household use. Please contact us before placing an order for commercial resale.

7. Prices and payment

The price payable is the price displayed at checkout when the order is submitted.

Prices include applicable UK taxes where required. Delivery charges are calculated separately and displayed before you place the order.

International deliveries may incur import duties, taxes or handling charges. Unless checkout expressly states that these charges are included, they are the recipient’s responsibility. Further information is provided in our Shipping Policy.

We take reasonable care to ensure prices are correct. If an obvious pricing error is discovered before acceptance, we may contact you to ask whether you wish to proceed at the correct price or cancel the order and issue a refund.

Payment is processed through Shopify and the payment providers offered at checkout. You confirm that you are authorised to use the selected payment method.

8. Dispatch and delivery

We normally prepare orders for dispatch within the period stated in our Shipping Policy.

Available delivery services, charges and estimated times are shown at checkout. Delivery dates are estimates unless we expressly agree a guaranteed date.

We remain responsible for the goods until they are delivered to you or to a person you have identified to receive them. This does not apply if you independently arrange a carrier that we did not offer.

Please ensure that the delivery address is accurate. Contact hello@whyteandsmith.com promptly if you notice an error. We cannot guarantee that an address can be changed after processing or dispatch has begun.

Further information about delivery areas, international shipments, delays and missing parcels is provided in our Shipping Policy.

9. Cancellations, returns and refunds

You may request cancellation before an item is fulfilled. You may also have a statutory right to cancel an online purchase after delivery.

Our Return and Refund Policy explains:

  • how and when to cancel;

  • the change-of-mind return period;

  • how to return an item;

  • responsibility for return postage;

  • refunds;

  • faulty, damaged or incorrect products; and

  • products for which a change-of-mind cancellation right may not apply.

Nothing in these Terms or our Return and Refund Policy limits your rights under the Consumer Rights Act 2015 or other applicable consumer law.

10. Promotions and discount codes

Promotions and discount codes may have separate conditions, including expiry dates, product exclusions or limits on use.

Unless stated otherwise:

  • a promotion cannot be exchanged for cash;

  • only one discount code may be used per order;

  • codes must be entered before checkout is completed; and

  • promotions are subject to availability.

If separate promotional conditions conflict with these Terms, the specific promotional conditions apply to that promotion, subject always to applicable law.

11. Intellectual property

The website and its content—including text, photographs, graphics, branding, logos, product designs, video and audio—are owned by or licensed to us and are protected by intellectual-property law.

You may view the website and make reasonable copies for personal, non-commercial use. You must not reproduce, modify, distribute, sell, license or commercially exploit our content without prior written permission, except where the law permits.

“Whyte & Smith” and associated branding may not be used in a way that suggests endorsement, affiliation or ownership without our permission.

12. Reviews and other submitted content

If you submit a product review, photograph, comment or other content, you confirm that:

  • you have the right to submit it;

  • it is accurate to the best of your knowledge;

  • it does not infringe another person’s rights;

  • it is not unlawful, threatening, defamatory, obscene or misleading; and

  • any incentive or compensation connected with it has been disclosed.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting Whyte & Smith. You retain ownership of your content.

We may moderate or remove submitted content where reasonably necessary, but we are not obliged to publish every submission.

13. Third-party services and links

Our website is hosted by Shopify and may use services supplied by payment providers, delivery companies and other third parties.

The contract for products purchased from this store is between you and Whyte and Smith Socks Ltd, not Shopify.

Our website may link to third-party websites. We are not responsible for the content or practices of websites we do not operate. Please review their terms and privacy information before using them.

14. Privacy

We process personal information in accordance with our Privacy Policy.

Shopify and other providers may also process information to operate the store, process payments, prevent fraud and provide related services. Further details are available in our Privacy Policy and the Shopify Consumer Privacy Policy.

15. Website availability

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend, withdraw or change parts of the website for maintenance, security, operational or legal reasons. Where reasonably possible, we will try to minimise disruption.

16. Our responsibility to you

We do not exclude or limit liability where doing so would be unlawful. This includes liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of your statutory consumer rights; or

  • any other liability that cannot legally be excluded.

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of that failure or our failure to use reasonable care and skill.

We are not responsible for loss that was not reasonably foreseeable when the contract was formed or for business losses suffered by a consumer. Our products are supplied for private use unless we agree otherwise.

Nothing in this section affects your statutory rights or any remedy available under consumer law.

17. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, provided that we take reasonable steps to minimise the effect.

If such an event significantly delays an order, we will contact you where reasonably possible. Your applicable cancellation and refund rights remain unaffected.

18. Changes to these Terms

We may update these Terms to reflect changes to our services, business practices or legal obligations.

The version applying to a purchase is normally the version in force when the order is placed. Changes will not remove rights that have already arisen under an existing contract.

The current version and its latest revision date will be published on this page.

19. Severability and waiver

If a court or relevant authority finds part of these Terms unlawful or unenforceable, the remaining provisions will continue to apply.

If we do not enforce a right immediately, that does not mean that we have waived it.

20. Governing law and disputes

These Terms and contracts made through our store are governed by the law of England and Wales.

If you are a consumer living elsewhere, you retain the benefit of any mandatory consumer protections provided by the law of your country of residence.

The courts of England and Wales will have jurisdiction. If you live in Scotland, Northern Ireland or another country, you may also be entitled to bring proceedings in your local courts where applicable consumer law permits.

Please contact us first so that we can try to resolve any concern informally.
